Protected trademark in Burundi

A trademark is any sign that can be represented graphically and capable of distinguishing the products or services of a company from those of other companies, and particularly words, names of persons, motifs, letters, colors, or figures. It can also be holograms, sounds, smells or tastes.

Requirements for the registration of a TM in Burundi

The service responsible for trademarks registration is the Director of Industrial Property at the Ministry of trade.  The following is required:

  • A reproduction of the mark in a format that makes the copy possible
  • A brief description of the products or services the trademark is intended or is used with
  • The class or the classes in which the registration is requested
  • Detailed identity of the applicant (the owner of the trademark) including name, full address, country of location, telephone, email address, website if applicable).
  • A copy of the search results
  • A simply signed Power of attorney written in French
  • If Convention priority is claimed: a certified copy of the basic application, together with a verified French translation thereof.

Term of a registered TM in Burundi

The registration of a trademark is valid for a period of 10 years from the filing date, with 10-year renewal terms indefinitely.
